When Walter Ngawati Toby​ was interupted doing an indecent act in his car, his first response was to ask the witness to hop in.

Toby, 59, pleaded guilty in the Palmerston North District Court on Tuesday to doing an indecent act.

The act happened at 2.40am on November 8 when he was parked in a car on Featherston St, Palmerston North.

A woman walking along the street walked up to the vehicle because she saw its lights were on.

She spotted Toby performing the indecent act.

She tried to walk away but Toby started the vehicle and followed, pulling up beside the woman and asking if she wanted a ride home.

She declined the offer before calling police.

Toby told police, “no one was around”.

Defence lawyer Fergus Steedman​ said Toby did not believe he had any issues which needed investigating.

“It has never happened before, and he says it will never happen again.”

Judge Jonathan Krebs​ however, wanted some checks done to ensure that was the case.

Toby will be sentenced in March.
